Help with small claim UPS COD

Hi I used UPS COD Services to send an item in the amount of $3,066.04 After 30 days I never recieved a check from UPS. So I contacted them numerous times getting the run around. Finally someone was able to send me a digital image of the check that I was supposed to recieve. The name on the check is completley mispelled from my name and the bank wont accept it. I even had to my bank call UPS and confirm its still outstanding and that its not cashable. UPS now claims they arent liable and wants to hold my money for another 30+days. I breifly looked over their tariff terms and conditions and to me it does seem they are liable because of their neglegance to collect a check with the proper name. There is nothing under there COD terms that says they arent liable for mispelled checks/ no delivery and theres nothing under their Liabilities and Limitations terms that claims they arent liable. I truly belive the agent with UPS is just lieing to my face and that the truth is they are liable. Can anyone help me to determine if I have a small claims case? Thankyou I will be happy to answer any questions if I didnt make myself clear
 
Have you tried to contact their headquarters to have this looked into? UPS is known for good customer service and by contacting the right department you should have this cleared up. Call headquarters not the local office. Demand that you be sent a replacement check ASAP. It is their problem to have the check cancelled out because of their error not yours. Hope this helps!

Thanks for the info.. Honestly I have been through over 3 different departments and they all give me the run around and have me contact someone else. Its honestly the worst service ever and the amazing thing is THEY are the ones that messed up due to their negligence and they claim that " they are not responsible". Which is amazing cause Its deffinetly not my fault.. and Its not the buyers fault they lost it.. so who does that leave?... I want to take them to court, but am jsut trying to make sure my case is strong enough first. I would hire a lawyer if i had the money, but thats why I was selling in the first place.. cause i dont have any!
