I understand that the repliers and admins hear enough about teenagers wanting to be emancipated and probably hear enough about "stress issues" or teen pregnancies.

I live in NC by the way.

But I really have a severe issue I need help with. I turn 16 in a few weeks. I was just recently involved with social services for the third time due to my parents' drug use and a lack of family to stay with. After a few weeks I was told to stay at my grandfather's house and he was granted power of attorney. My father has never had anything to with me and just recently started talking to me and allowed me to live with him after my mom relapsed but it turned out my dad was also on crack [I know this because I found his paraphernelia and reported it to the police] and had his face plastered all over the evening news and the front page of our local newspaper. My mom is in no condition to take care of me because she is a recovering crackhead and my dad is no longer allowed to have contact with me, although DSS allowed him to let him make decisions where I was to go. This frustrates me because he has never had anything to do with me yet because he was blood-related he still had parental privileges which I DO understand. But anyway I ended up staying with my brother's in-laws for two weeks and everything was fine. They were going to fight for me because I had expressed that I didn't want to stay with my grandfather because he has peripheral neuropathy, which has spread to his face, and can he end up in the emergency ward at any given moment and is in danger of having his legs amputated. I currently am in college and by the time I graduate high school, which is next semester, I will be a semester short of my associates degree. I'm in a dual-enrollment program funded by the state. So I rely on transportation A LOT just to get back and forth to college but by staying with my grandpa it WILL eventually become an issue either today, tomorrow, or next month. I have been in contact with Cornell University (which I am proud of by the way) about financial aid and they have informed me that my condition, academically, will easily allow me to be accepted if I apply there, so I really need relaible transportation to stay in college right now for my application. My grandfather, I do love him, is now sleeping on the couch because there isn't enough room for all three of us; my sister is also staying with us. I feel horrible and he puts me through a guilt trip everyday about me staying there and running his bills up which is understandable because he relies on government checks and the flea market to support himself not counting two other children. He's already sold a van just for money this week. My choices are to either stay with him or go to foster care and I don't want to go to foster care because I can end up near the Tennessee border since I'll be in state custody. I want to emancipate or just be able to move into the in-laws house. We had reached an agreement that if I wasn't able to stay there then they would hire a lawyer and try to get me emancipated. Any legal advice on fixing my situation will be appreciated.

I understand that the court system will take into account the following measures in statute 7B-3504 in Article 35 in the NC Law regarding emancipation that I require:

The Parental Need for Earnings of Petitioner.
Does this concern my earnings or any kind of income I receive from gov't or child support?

The Petitioners Ability to function as an adult.
I have never been involved with any legal dispute or been in any legal trouble or been suspended from school :P

The Petitioners need to contract as an adult or to marry.
I'm not marrying just trying to live by myself.

The employment status of the petitioner and stability of the living arrangements.
I have a home business that I will have to get a Home Occupational License for to legitimize the income.

The extent of family discord which may threaten reconciliation.
My family is limited to two people that have absolutely anything to do with me not including my parents, my dad already says he "disowns" me and my mom is just "ashamed" of me, plus she blames me for what happened since I left her to go stay with my dad.

The petitioners rejection of parental supervision or support.
As far as I'm concerned the "parental supervision" was non-existent.

The quality of parental supervision or support.
Non-existent.

I understand that me having a plan to stay with someone defeats the purpose of emancipation since I have to prove that I can do everything to support myself on my own. So what if I had someone let me live there for a ridiculously low rent or boarding fee? What if the license holder was someone I could trust that way I could be hired, therefore giving me a reliable source of income? Will my extremely early graduation and extreme concern for my College Education have an effect on the outcome of the hearing? Any help with be appreciated! Thanks! Remember to vote for Ron Paul!!

How much are you currently earning from your home business?

How much are you currently earning from your home business?

Anywhere from 400-700 dollars a week. I do computer repair, mostly maintenance so I don't run out of a market, like spy ware removal or home networking. My plan is to have someone I trust be a license holder [I would get a Home Occupations License to make the business legitimate] and "employ" me that way it's just like being employed anywhere else. Of course I currently have an account to fall back on in case of emergency. So in a nutshell I hand over the licensed business to a trusted person, my brother who originally wanted to take me in, and he employs me to work for him, he is 22. That way it doesn't look like I'm not risking anything financially.

Is it any different being employed by him than being employed somewhere else?

Another thing, I heard of filing a petition for guardianship to stay with someone. So can he file a petition and get me through a court process?
