I really need some help. I am being sued for an old debt. I filed a response, and for a motion to dismiss. I now have a hearing set for this. I am asking for the judge to dismiss because of the SOL has expired.
Last payment was November 2003 and case was filed on Jan. 2004. Oh, I am in the State of Texas which is 4 years. Can I file a summary of judgement? Or do I need to show up for the hearing and provide the evidence I have to support the SOL?
As you can see, I am representing myself because I am a single mother and can not afford to pay someone. I am probably shooting myself in the foot, but I don't know what else to do. Can anyone please help me? I am in school and trying to better myself.
