Help! Paqrental Kidnapping???

My aunt had to leave her husband after finding out that he was dealing. She has no proof, but she left her state (MD). She has been gone for 3 weeks and is not sure if she has committed parental kidnapping. She is not interested in filing a protective order, however she wants to stay away from him until divorce papers can be filed. If the child has been taken across state lines, is it considered kidnapping. Also, if he knows where they are is this okay? Where should she go from here?

Your aunt cannot file anything until she has met the residency requirements in the new state. Until then, Dad's state has jurisdiction if he files.
