Help on gaurdianship

For about five months I have had my nephews age 7 and 10 living with me. Their father is going to prison [aka my brother ]. The mother has existing warrants in another state and is currently so to speak on the run. She has no adress because of this I only know the state and possibly the city where she is , but she won't give address for fear of being arrested. She calls about once a month ususally not always. I would like to get gaurdianship of my nephews but how if I can't get a hold of her and all I have is an old out of state address? When she calls the caller ID shows up as blocked most of the time and it's not her phone. History/ she has the kids usually 6 mon.s to a year than calls me up asking me or their father to come and get the kids from whichever state she drags them off to. The children have been in Il. since January, so they are again residents legally now [MY parents made that mistake when they they tried to file before] The school here has the documentation of the kids being in and out of the school system here. My family and I have spent too much time and money going and getting the kids just for her to come back and drag them off to another state again in 6mons to a year, its frustrating does anyone know what to do about the above ?'s I really can't bare to see this happen to them again, also the children want to be here because they know that we have provided a stable and safe home for them. One more ? I HAVE A NOTARIZED PAPER from the father saying I can care for them The mother had verbally told me she would like for them to remain in my care till she figures out what she is doin with her court stuff [which I called and found out were warrants in another state] how do I handle this? Also what do i do about her where-abouts if we cant get her to tell us an address and she is wanted anyways? How does that work? Need advice asap...

Contact your county clerk's office to get the forms you'll need to file for custody or guardianship. Since the children have been left with you voluntarily and permanently, you should be allowed to file. The fact that you can't find her should not be an obstacle.

When my niece went to Jail, her husband was still out somewhere, and my mother had the baby, They never took care of the baby and was very unstable, she went to the courts and filed for emergency full custody, this gave her the ability to take the baby to the dr. take the baby anywhere, even out of state, and in the papers it stated she had tthe right to do whatever she need such as schools, daycares, etc for the child.
