Hello, I was hoping someone could kind of walk me through filling out the form for a Motion for Contempt of Court regarding late child support. I just want to word it correctly and not come across sounding like an idiot.
Here is where I was hoping someone could help me fill in the blanks :
My name, respectfully moves this Honorable Court to grant this Motion to/for ____________________________, and as grounds therefore would show:
1. ________________________________________
2. __________________________________________
3. ____________________________________________
4._____________________________________________
This is what has happened: he has missed the last 2 payments. Last payment was made on June 18th 2008 his payments are biweekly and are made through an income deduction order (so why they have not been made not me, the county clerks office nor the child support agency know- he has not notified anyone of any job change or anything else). His 1st missing payment should have shown up in the system by the 2nd of July at the latest and then the next one would have been the 16th of July (today). I have already tried contacting him to see if there is a reason but he has chose to not reply. I wanted to be fair and see if something was wrong and that is why he had not paid I am not trying to be vengeful or anything else. But now after him missing 2 payments I decided that I guess I need to do the right thing and get it resolved before he misses another one. He has also missed payments in the past so this isn't the 1st time or the 2nd time. But he would always make the next payment so nothing could be done to him. He had found ways to get around making his payments each time. He shorted us in November 2007 and also in February 2008.
So if someone could help me use the right wording I would greatly appreciate it. Thank you so much.
Additional info = he has to be late more than the amount of 1 payment and has to be 15 days late before I can fiile for contempt of court per my county. Not sure if that is the norm or not.
**Also do I have to send him or his lawyer a copy? Or can I just submit it to the court and let them do that??
On the bottom of the form it says:
Certificate of Service
I hereby certify that a copy hereof has been furnished by mail/hand delivery/personal service to the persons listed below this _________ day of ________,2008.
Party or their attorney (if represented)
