Help for my Senior Mother

Hello,

I am from Santa Barbara California.

My mother Carmen will turn 74 in January.

Mom was married to my Father for 18 years before divorcing when I was 5 years old.

She re-married to an illegal alien from Mexico in 1994.
This marriage turned out to be very bad, as he was abusive and appeared to be using her to gain US Citizenship. They were together for approximately 4 years before she got the nerve to flee.

It is now, 2008 and she has never filed for a divorce.
She did not help him obtain his papers for citizenship and has not seen him for over 20 years...in fact, his whereabouts are absolutely unknown and has been the whole time.

My questions are regarding the Laws of the State of California and divorce/annulment.

Can she still have this marriage annulled?
Is there a way to prove that she hasn't been with him for over 20 years?
or that he was using her to obtain citizenship?
Is the fact that she's sat on this information for so long going to make it hard to do?

I am stepping in as a concerned son. Up until a few months ago, I was under the impression that she was divorced.
