Help, child needs both parents!

My boyfriend (after a long struggle) finally has physical custody of his son. After the mother moved the child around to 3 states in less than a year, he is finally stable and living with us in NY while she lives in FL. My boyfriend wants the child to continue to live with us during the school year but does not want to keep him from visiting his mother in the summer, even though she kept his son away from him and used the child to get money for almost a year. The problem now is this. He cannot file custody until the child has been here 6 months and is a resident of NY to his knowledge. That would be in June, when summer starts. Court would most likly not be until August. So if he lets the child go, there is no way to prove he still has physical custody. So the mother may not come to court. And there is no way of making sure she brings him back. There is currently no court order or court appointed custody. Please help, is there anything he can do to be able to let the child go but be sure she will bring him back and/or a way to avoid her contacting the court and stating she has physical custody. He fears she will refuse to come to NY and claim the child lives in FL with her? Or does he have no choice but to either wait for court or take a chance with trusting her? She kept the child from him for a year and exploited the child for money, he can't trust her. Please help
