I had to take submit to a background check for a cna position in michigan I have felonies on my record ...a few weeks later the licensing board sent me a paper saying my charge obtain a controlled substance by fraud is a lifetime ban from nursing I looked up a few things and it says prescription forgery is a 15 year ban so I appealed the letter and asked them why this charge is a lifetime ban when it clearly says that forgery is 15 years ....so I need help from someone who understands michigan law .....is the charge obtain controlled substance by fraud a lifetime ban or 15 year ban ? Need help

Is the felony charge obtain a controlled substance by fraud a lifetime ban from working as a cna or a 15 year ban... I don't understand the law the licensing board says it falls under manufacturing , distribution ,prescription of controlled substance life time ban .....I think it should be 15 year ban for forgry of prescription ....I need some clarification on which level this charge falls in

Look at it this way, 15 year prohibition from obtaining a CNA certificate, or a lifetime prohibition, not much difference.
Why do I make that statement?
Think about it, if its life, you'll get to 15 years long before you die, or stop working, statistically speaking.
You won't get a license until 15 years has elapsed, and by that time, your skills will be rusty, assuming you wish to still work as a CNA.
No way by this one until at least 15 years have rolled by.

This happened in 2002 I just got my license so in 2017 I could work .... that is why I am asking

If you have a remedy, you take it up with the licensing board in Michigan.
You can probably forget working in that career field if the licensing agency says you are barred for life.
You are always free to consult with an administrative law attorney in your county.

You should have checked with the licensing board before going/trying for your CNA license. It seems you already appealed the decision. You might talk to an attorney but you could be very well banned for life for this type of work with your history.
