Here's my case:
i received a misdemeanor citation for gambling
promotion [39-17-503], which seems to be a class B
misdemeanor.
I was processed and later my case was dismissed on the
basis of Nolle prosequi. i ordered for an expungement
of my records.
After 7-8 months i made sure that my records were
expunged. I also obtained no arrests/warrants
certificate from the sheriff. I also have the order of
expungement copy.
My H1-B status has been approved and i am planning to
visit home this year. I am a little woried about my
H1-B stamping now.
I have a few questions to ask in this regard:
1) will my H1-B stamping get rejected?
2) will my arrest have any implications on my H1-B
visa stamping?
3) what documents do i have to take to the american
embassy to convince them ?
4) Do i have to have the FBI clearance/record check
before i go the visa stamping?
5) Do I have mention that i have been arested and
later the case was dismissed and show the officials at
the embassy the documents i have to convince them that
everything is fine.
6) Is this case a petty one?
Your suggestions and help is very much appreciated.
