guardianship of nephew

My nephew died in April,His wife was killed in an auto accident last week leaving their 2 yr old son in need of a guardian.They live in WV we live in GA.
My nephew was striving to move out of WV when he died. His wife was starting to get her life in order to make life better for her son. Now his moms sister has temp custody. He is now living in the same conditions they were striving to get him out of. My husband and I are in our 45-50 range still very active and healthy.My nephew always came to us with life changing decisions and his wife came to me when he died I was the main person to help her through the processes. I am trying to figure out what kind of chances we have of getting custody of him. And what i need to do to make it happen.There was no will saying who he goes to.:confused:
 
You cannot will children anyways and a family court is going to prefer any relative that lives in the same state as the child. You need to hire an attorney but for any chance at custody or guardianship you have to prove where the child is, is totally unfit. Whatever you claim your nephew was trying to do or said to you, is hearsay and cannot be proven anyways. So a court is not going to remove the child unless totally necessary.
