guardianship/adoption

Alright here is the situation. "Kelly" has two kids. The oldest her mom (who is not with her dad) is raising. The second (whose dad is unknown) is being raised by her dad at the house that she lives at with him. She has nothing to do with the baby and her dad only has him because he didnt want the lesbians who were going to adopt him to have him. (whole other issue)...

Now, my husband and I, who know the family, want to adopt the baby. They want to let us. How would we go about it? Would the mom have to sign over guardianship first (so I can get the baby insurance etc...), then we go about adopting him? Would we still have to go through the process that everyone else has to go through when adopting the baby, even though the mom chose us for the baby?

Any advice would be great! Thanks!

You need to see an adoption attorney. First of all, the fathers have to be found and their rights terminated. You have to idea whether or not mom will agree to this but you should start with seeing an attorney.
