giving up rights?

My ex husband wants to give up his rights to our two children, he told me to file the paper work ???? I dont know how to get started because were in two far apart states I also want to know if he will still have to send child support?

Are you married? If so for how long? Is your current husband willing to adopt? If your not married or have not been married at least one year and your hubby is not willing to adopt the TPR will not likely be granted

on 04/20/2008 i would be married to my husband for a year. He is more than willing to adopt the children..

Wait till after 04-20-08 go to family courthouse and request proper paperwork. Be sure your Ex is aware of what your doing and is ok with it. Most Family courts have people present to help you with paperwork but do not give legal advice

when the children get adopted can there last names be changed? And how much will it cost for this when the biological father is willing? Also will he still be liable for child support ?

I really dont know of adoption cost I will guess two or three hundred this is not counting the TPR. Check with court about payment, payment plans, or other options not all families have money so there may be options open to you

Your husband is adopting them changing their names to his should be no problem. With your husband adopting them he is now going to support them. However any arrears owe by Bio Dad do not go away

why would your ex husband want to do this? Is it really in the kids best interest? He does realize that your husband will have to adopt them, and he will become a legal stranger to the kids? Futire child support an all rights will be terminated.
