We're in the apartment for about 8 months now, with 4 left on the lease, and we've split up. She wants to move out but wants off the lease and I agree wholeheartedly. The problem is that we've basically used her checking account for billpaying with mutual money, so the checks have all been paid with her name on them only (landlord may not want to have her leave). That said, when the lease was originally executed she did sign it, but her name did NOT appear anywhere in the contract listing her as a tenant. I'm prepared to approach the landlord this next week, but am concerned that his wife the first year law student will simply see this as a chance to exercise her legal muscle and refuse. Any advice as to whether she is even legally bound to the lease as it is or a smooth way to remove her from it?
