i have a complicated issue and i would greatly appreciate the help. i live in the state of texas, my girlfriend and i have a 15month old son, we broke up for about a year and i wasn't able to see him much so i filed child support on myself to get visitation orders with the attorney general... well recently we got back together and now she and my son live with me, but she found out her family was moving out of state and she is planning to go with her family to california. generally speaking, would i be able to fight this move? can i refuse to let her take my son if she is staying at my house and all my sons belongings are here in my house?

the court order we have says that i'm the NCP and shes the custodial parent, but i was the one who opened the case, and the attorney general informed me that i am able to close the case. so if i close the case do will i be able to use my natural rights as a father to be able to fight the move? i would really appreciate any feedback, he is moving in less than a week and i would be willing to not let him leave my house if my girlfriend plans to goto california with her family

i do have a court order for visitation, but there is a part on it that says the mom is entitled to choose where the child lives no matter the geographical location. is it possible for me to remove the court order and goto my attorney general and close the case since i was the one that opened it to start the court order?

It sounds like you do not have a court order yet. In any case, it also sounds like you have a parenting plan agreement that allows the mother to move anywhere. I think it will be difficult to get that changed since you agreed.

You need to see an attorney today!!!
