I am writing this message for my friend, who is a german citizen (permanent resident of the US), married to an american. They have a son together, who is 8 years old.They are currently stationed in Italy. The father has received orders (DOD) to return to Rock Island, and they have to leave within the next 45 days. The marriage has been rocky, and the mother is terrified that, if she decides to move with him to the US, and the marriage ends, that she will loose her son. She would most likely return to Germany if the marriage should end.
I am asking if there is a binding and rightful agreement they could reach, where the father gives the mother full custody ( as a guarantee that he will not take the child from her in the states). If there is such a document, can he change it without her approval? Would an agreement like this be temporary? Would it legally protect her?
