Gaining legal guardianship over nephew

I am doing research with a friend because her family has recently been hit a number of tragedies in a short amount of time. Here's everything laid out:

Mary's (my friend that is in need of major help) sister and brother-in-law died in a car accident almost 2 months ago. In their wills, they left their son, Kru, to Mary's parents. Kru went to stay with Mary's mother, but 2 weeks ago, her mother tried to kill herself because she couldn't handle the death of Mary's sister. Mary's mother went to the mental hospital and Mary picked up Kru and has had him since then. Mary's father cannot be alone with Kru because he has been in and out of prison for years, so he is not a suitable guardian.

For now, Mary has temporary legal guardianship over Kru and she is his power of attorney. Unfortunately, she has no money to help take care of him and she's depending on Wic and Medicaid to help her take care of some of Kru's expenses. I'm wondering about how she goes about getting legal guardianship since neither of her parents seem to be fit guardians. Also, Mary's sister had a trust fund for Kru that is currently going to Mary's father, so how does she get that? Will she be able to collect Social Security if she's only the temporary legal guardian of Kru right now?


Thanks for your help in advance. This is just an awful situation and I'm trying to help her in any way possible.
