From Salary + Commission To Commission Only

After working with my former employer for 5 months, they reduced my pay from salary + commissions to commissions only. On my commissions, they did not take out any taxes.

Mid-August I was asked to sign a W-9 and back date it to the date the new pay structure began. I did.

A week and a half later, I was terminated. The company misclassified me as a contract employee, which I was not. (I have already defended the 20 points posted on the Texas Workforce Commission Website).

Will I be responsible for the taxes?

Also, I was terminated 8/22/08. My last check was dated 9/23/08 and mailed to me on 9/30/08. From what I have researched and pointed out in a wage claim I have filed against this company, the company is in direct violation of the law. Will the company be assessed with fines for this?
