I am being sued and the details of the case aren't really needed to answer my question so I'll omit them for now.

I am confident that his claim will be dismissed. However, I am stuck paying for a lawyer to defend myself.

I am curious to see if I have any rights to regain these costs. I see this as a frivolous suit. He is representing himself and has nothing to lose but some time. Can I bring a case against him for damages somehow? How is this sort of thing done? My lawyer said I really don't have any options, but I feel that there should be some check in the system or people with nothing to lose would be suing everyone! Anyone that watches Judge Judy sees that both sides are always counter suing each other!

So what are my options? Thanks!

Hi I read that in small claims if the person suing you loses, he/she may have to pay for your time and and other things. But don't expect to get much at all if a few hundred dollars at the most. The person who sued you wasted some of his her money as well to sue you.
