My husband and I live in Atlanta, GA and we had to hire an attorney and go to court to get a court order filed against his wife due her to refusal to pay the portion of the 401K funds that she agreed to in the divorce decree.
We have the court order and she has been ordered to pay the 401K funds as well as the attorney's fees we had to pay. We are pretty sure that she has closed out the 401K account and need to know how to go about enforcing this judgement in Texas. Our attorney says that we would have to get an attorney from Texas to take care of this, but after reading Chapter 35 of the Texas Civil Practice and Remedies Code, it looks like I can file this myself. I just need to know what steps to take. I have called the clerk of court and was told that I would have to get recommendations from an attorney.
