Foreclosure/Repayment

    Hello,

    I'm curently in foreclosure/repayment with my mortgage company. I have until April 2009 until I'm current again. If I wanted to move to a new home for a lesser payment,would I still be liable to pay off the balance of the repayment loan?

    You would be liable for your repayment plan and the balance of the mortgage. You have signed loan docs for a home, until that full balance is paid off and the house is outta your name you are responsible for it.

    File a Ch. 7 if you are walking away or moving, I would try to sell it as a short sale with a Deficiency Judgment first though.

    I am not a lawyer.
