My ex and I finalized our divorce 5 months ago. He moved to Delaware. I am still in Florida with our children. He has filed for a modification of child support. He was only ordered to pay 5 months ago. He didnt pay child support the from the very first month he was ordered so child support enforcement and the department of revenue are involved. He has been paying but on his own schedule. The DOR filed a "Motion to dismiss" repsonse to the modification request. How are situations like this usually handled? Will the judge listen to the DOR since it has only been such a short time?

It depends on the circumstance for the reduction. If he has lost his job or is not volunatarily unemployed or underemployed they may entertain it. If he has filed for a reduction just for the heck of it, it probably will not go very far.
