A workers comp claim does not prevent you from being terminated.

You are free to consult a workers comp attorney.
There must be several in your county.
Visit one.

It is a myth that you cannot be fired while under a doctor's care, or while out on workers comp. You didn't post your state but in most states, your employer held your job four times longer they were required to by law. If you've been out of work for a year and are still not able to come back, it is legal in all 50 states to let you go unless a legally binding and enforceable contract or CBA expressly and in so many words says you get longer than that. It will not affect what you are entitled to under workers comp.

Agree, there is no state or federal law that offers job protection for a year. (unless you have a binding employment contract or CBA to the contrary)
