I have full custody of the child because the mother abandoned him for 8 years, not a single contact. She showed back up last year and tried to get visitation, which would not be granted until she completed a list of things that the judge ordered. To date, she has not done these things. At that time, my lawyer set up child support which came to a whopping $114 a month. She made 3 late payments, then sent 3 bad checks, then stopped all together. The order has been in place since June 08, so she is about 9 months behind on an order placed a year ago.
Ive been touching base with my attorney since the first late payment, keeping him aware. He has been telling me that he will file contempt, but each time I check in with him, he has not done it. Claiming that I never sent him the info, which I had all in email and reforwarded to him yet again. (I had to do this several times) He replied back with the contempt ppwk for me to sign and advised me that he will ask for her to pay the atty fees for this but if not I have to pay another $500 for him to file the contempt.
I was just wondering if this additional fee sounds right, from an attorneys perspective. I wasnt sure how much was covered under the original retainer, and this is only the first contempt filing since the order.
