Fighting to keep custody...

I am a 23 yr. old mother currently in college and working full-time. I was served a summons for custody of my 5 year old son, by his father who has just recently become a part of my childs life. I had a verbal agreement with my sons grandparents that he would stay with them temporarily and go to school from there home until I could find adequate daycare for him where I live. Since then, the grandparents have been trying to talk me into letting my son live with them permanently and move with them to Georgia where they have another home. I told them that I would not allow that to happen and reminded them that the agreement was for my son to be with them temporarily, and now the are breeching our original contract and trying to establish full custody of my son. I need to know what steps I should take other than removing him from their home.
 
Is your original contract with them a legal, binding contract that was filed with the court? If not, you may have some trouble. How long has your son "temporaily" been living with them?

At this time Dad is free to seek custody, He is dad and he does have rights. You can consult with an attorney and see what your chances are of retaining custody. Quite honestly, if I were you, I would be looking for day care. Have you filed for child support? Since you were served you can show up in court but if Dad has an attorney and you don't, thats not good.
