If my husband is current on ongoing support is it legal for agency to take IRS refund especially if the case is under appeal? He is current for ongoing and for the amount withheld towards arrears. We have requested audit for arrears as he actually does not owe this either. To top it off the supposed arrears are for children that emancipated over 5 years ago. This is in California if that matters. Does not the amount reported to IRS have to be verified?
