Recently I had to replace/ repair a leaking roof that was leaking at the chimney within the same year our home was built. The builder blamed the chimney installer who blamed the stucco who blamed…. I paid for it all. The roof continued to leak because it was always the flashing improperly installed. I called the builder now several years into this and he said he had no money. Again, I paid.
A few months ago I noticed an area of shingles displacing on the roof and got up there and found plenty of roofing nails lying around so I called the roofer that I paid to fix the flashing a month earlier. He inspected the roof and showed me where the entire roofing was installed improperly and this problem would continue.
I've closed on this home about 6 years ago last January and if I have recourse I will conduct business through an attorney after the builder's last conversation. What is the liability to the builder, insurance or warranty wise?
