Hi ,

I am looking for some help please.

This is my story. I am a 26 yr old Male in the UK , I dated a girl roughly 5 yrs ago. We split up and after 6 months of no contact she told me she was pregnant, a few weeks later she told me she lost the baby. Anyway a few months ago she now tells me she kept the baby and she didnt loose him at all and I am the father. The dates do add up and im determined to find out the truth. Due to the lies she has told me in the past (many lies) I dont take her word for it I want a DNA test to prove that the baby is mine. She has said that she will do a DNA test but I have been trying to get her to do one for a few months now and she always has some kind of excuse to get out of it like she is going shopping or she just ignores me, I am sick of her games and excuses and want this test done NOW, im sick of waiting.

How can I take this to the next level, i.e. can I make her do a test in court ? what are my legal rights for taking her to court about this? if the child is mine do I immediatley get parental visiting rights etc?

I really want to avoid this going to solicitors and courts etc but as she is not really co-operating I need to think about my other options?

any help will be most appreciated.

We are generally familiar with US law only. However it probably works similarly in the UK. You can sue to establish paternity. The court will order a DNA at your cost and if the child is yours they will establish child support and visitation. That is how it would work here in the US anyway.
 
Similar to JHarris post here -

I'm in a similar situation regarding getting a 'past situation' claiming responsibility for a child.

One of the ways around it was to push the Home DNA test angle - they can send the sample (ie; swabs) from home for anaysis to an accreditated DNA test facility.

Not sure if I can publish a link to a site here, but I used DNAtesting.com. It might not be legally accepted, but the accuracy rate is so high @ 99.99% it solves the whole issue.

Once you get those results you will at least know where you stand and then decide if you need to pursue a court-approved test.

Doing it this way doesn't really allow an easy out for someone pointing the finger at you to not test!
