Father wants to claim son on taxes.

Me and my son's mother were never married, and never went to court over things like who gets to claim my son on taxes. She always has and never lets me do it(for six years now). This last year she hasn't had a job cause her new husband supports her. Someone told me if I claim him first there is nothing she can do about it, is this true? also, yes I pay my child support on time and don't owe any rearages.
 
Yiu need to go to court and ask for the tax credit. You legally cannot claim and if mom also claims, you will lose the audit because unless the courts give you the tax credit, you cannot claim. The IRS is going to ask for proof of you be allowing to claim or ask who the custodial parent is. Since it is mom, you will probably lose the tax write off.
