The father of my two kids has been here illegally for more than 10 years. He came to the U.S. illegally when he was a kid. We currently have two kids. He is the head of the household and makes ALL the money to support us while I stay at home and take care of the kids. He has been issued a working permit few years back allowing him to work, collect his taxes, have a SS number, and drivers license. We renew this card every two years. What can I do to help him become a legal citizen here? I heard that in order to get citizenship through marriage you have to have come here legally.. does the working permit change this rule? Does the being head of household and having two kids with me make a difference? How can I help him without him getting deported back for 10 years?

Seems to me that if he was issued a work permit by the US government then he's not here "illegally."

However, the road to citizenship is complicated.

I suggest he consult an immigration attorney and review his options.
