Father looking to gain custody of daughter

My husband was served papers for a child custody/support case from his exgirlfriend and mother of his six year old daughter. She refuses to answer our calls and won't allow her to call us. We are desperate for help. I am currently the only one working and he is a stay at home father to his 3 yearold step daughter who may have autism and our 6 month old son. He's not working at this time because my daughter needs constant attention to thrive and function normally. Untill I get my schedule changed one of us needs to be home and since there is no work available for him, we decided that I would go back to work after surgery. We believe that the only reason that the case was started was because at the begining of summer we were supposed to go to Texas to pick up Alison and I had just gone back to work and we couldn't afford it. I had asked Alison's mother to bring her to Ohio where we live and we would take her back to Texas. She became upset and shortly after that he was served court paperwork. What can we do?
 
There is nothing you can do , you are not party to this and he has an obligation to support his kids. child support will likely be ordered, if you are the only one working then you can pay it to keep him out of legal trouble, or dad is going to have to find some employment outside of the hours you work. he had this child first, his obligations do not go away because he has asnother child and your 3 yr old is not his child so she is not factored in here at all. You need to file for child support on her if money is that tight.

Dad should google the state child support guidelines so he knows what to expect but it is not realistic for Dad to not support this child.
