Father gone for the last 12 months, can I get his rights terminated?

My child was born Dec 26th of 2008, her father is not on her birth certificate and has not seen her or attempted to make contact with her or with me since January 12th of 2009. He's never paid any sort of child support (nor have I attempted to seek any) and there is no proof of paternity (as far as legally binding proof of paternity). Do I have sole custody of her? Do I need to go file some sort of paperwork to have his right's terminated or is there some sort of legal process I need to start to ensure that should something happen to me that she CANNOT go to him? HELP!!
 
You are currently sole custodian.

You cannot terminate his rights, because he has not yet established any rights. File for child support - that's when the "abandonment clock" starts ticking (well, from the day child support is ordered, anyway).

You can arrange a standby guardianship nominating someone else to be the child's guardian should anything happen to you, but this does not guarantee that Dad cannot get custody.
