Sex Crimes, Sex Offenders family member's shay boyfriend

:confused: A family which has 3 small kids from a previous marriage has a boyfriend (met online) from MA. He told her he has a lewd and lascivious charge from when he was younger. He claims to have been caught having sex at 16 with his girl friend in a public place. He says he was charged as an adult. He has a criminal background for stalking charges also. I am worried about the story concerning lewd conduct. He is now lving with this family member and the kids are young ages 10,7 and 4. I tried to check for sexual offender background but MA does not give out that info. My question is does the lewd and lascivious charge match with his story?

Massachusetts General Laws Chapter 272 Section 16 reads:

Section 16. A man or woman, married or unmarried, who is guilty of open and gross lewdness and lascivious behavior, shall be punished by imprisonment in the state prison for not more than three years or in jail for not more than two years or by a fine of not more than three hundred dollars.

As you can see this is a catchall provision, since it doesn't really define what is lewdness etc. So it is absolutely possible that he would be charged for the sex in public under this section.

This is not really a legal question, but I thought I'd jump in.

What is your intuition telling you? If you have children and get aany wierd vibes from this guy, best advice is to just stay away. Let me know what has transpired since your last submission.
