Arrest, Search, Seizure, Warrant Fake Warrant

my brother was recetly charged with murder, a crime he denies even being involved in. They arrested him at his girlfriend's home and afterwards, she realized that the warrant that was given to her for his arrest was fake....wrong name and the date was 2005. Also when he was seen by the judge, they did not even have the name of a victim. Does he have a good chance of beating this?
 
Murder has no statute of limitations.

Is the warrant fake?

Were the police fake, too?

Is your brother in a fake jail?

The 2005 date isn't a problem. It may have been outstanding since then. The different name could be an alias, and it isn't necessary to know the name of a victim if you can prove he killed him/her. Get a lawyer.
 
How did you come to your conclusion it was fake?

Him beating it?
If the arrest warrant was in fact fake or seriously incorrect,the best challllenge you would have is to supress any evidence found in the house that stemmed from that fake warrant.If in fact it was fake.

Police are known to use any type of paper to show a homeonwer to gain acess to the premises. Then use tricky words
That dont mean that they did not have a warrant for his arrest.
They bank on most people not asking to see it.

Like said above,the warrant was issued years ago and most likely an alias.

EX. He has a warrant for his arrest,but the search warrant is for his adress only.
Hes at his girlfrielnds house.
The police knock and say we have a search warrant for Mr jones ,may we come in please and have a look around?
Hand you the paper ,your nervous and by the time you gain composure,they have him in cuffs and your yelling about wrong name and adress.

You already allowed them in.
Your word against theirs.

If your ever presented with a warrant ask "demand"to read it completely before complying.
