Eye Injury While Sub Teaching

Hello! I really need some legal advice on whether I have a case or not. Here is what happened. I was a sub teacher during the 2006-2007 school year. Current year has not started yet for me. Anyway, one day last year I was subbing as a gym teacher and I was accidentally hit in face with basketball by student. I was okay at the time so I brushed it off and did not fill out any form. But now, when I went to go update driver's license and took vision screening I had trouble seeing out of left eye and so made eye doc appointment for that week ( a couple weeks ago) and the doctor noticed something in that eye. He sent me to specialist who after several different tests said I had new blood vessels form there and because they did not form recently, there's nothing even experimental he could do. The eye would not get better or worse. My regular eye doctor asked if i head any head trauma when he was trying to figure what had happened. At the time, I didn't think I had any. But, now that I'm trying to figure out what happened, I think this might have played a role in eye problem. Do I have a case? What action should I take? Would appreciate any advice you can give me. I'm not sure what kind of insurance you may have had as a contracted gym teacher. Did you check your agreement or discuss this with anyone?

With regard to your injury, what kind of money will it take to "make you whole?" Right now we are talking about a couple of broken blood vessels which I understand are supposed to heal. I don't know how severe your problem is but this is usually temporary. Add this to the fact that you think that this one time seemingly innocuous event of getting hit in the eye MAY have been the proximate cause of your injury - you're not even sure.

My guess? Unless this injury is long term, severe, and you can show the connection to what happened a while ago, you have a difficult "case." If you were covered by some type of insurance or workers comp, then perhaps there is a reason to pursue remuneration for the expenditures you've had. I'm also not sure what kind of case you're looking at.

If you and your doctor think that the eye problem was caused by the accident with the basketball, you can certainly file a workers comp claim. I would not delay on that since most if not all states have time limits under which you have to file.

If you are wondering whether you can take legal action against either the school or the student, that's a different story. Is that your question?
