Criminal Law Extramarital Affars and Green Cards

My sister has been married to a foreigner for one year and several months. He has a conditional permanent residency. She suspects that although they both entered the union in good faith, he may be cheating (they are having some marital problems). If she can prove the afair, does that constitute grounds for deportation?

No. Adultery is no crime any more. What she can do is divorce him, then the conditions might not be removed on his green card and he would therefore lose the right to stay in the US.
 
Another question - please respond

If she divorces him now, what are the chances of him being able to renew his green card and stay? Aren't they quite slim, especially if the affair is proven during the divorce?
