Ex-spouse is taking the kids out of state for the summer, and has a new address

The non-custodial parent is about to take the kids for the summer, and has a new address. Are they obligated to give it to me before taking the children out of Florida to thier home in Delaware? If they do try to not return the children to me at the summer's end, what action should I take and in what state (mine or theirs) should I file charges?

P.S. we have both moved away from the state of Indiana, where the original divorce and custody decree was filed.

Have you checked your court order to see if it requires NCP to disclose a new address? Since 2006, Indiana has required notification of any move (CP/NCP), but I don't know how this would affect you if you were divorced prior to 2006.

If the NCP fails to return the children, you will have to file for contempt of the custody order, and I believe you'll have to do so in Indiana.
