Ex claimes daughter on taxes 2 months after born.

Okay, my ex verbally abused me into giving him my daughters social security number around tax time. he was late on his taxes, he kept saying im gonnw claim her im gonna claim her. she was in MY stomach from april-dec 14th 2008......he paid the rent for his house that i was staying in... thats all...from july 08-jan09, however he never really paid the rent, we almost got thrown out becuase he never paid... i paid EVERYTHING else, the lights, the heat, and all of my food!

sooo he got his grandma to give me the social sec. number of our daughter and told me not to claim her or he'd flip. so i didnt and he did, b/c he owed alot of money i guess.

so i never signed anything saying that he could and he was not the provider of her and hasnt bought her anything or sent money or really even seen her..
so i need to know if it was illegal for him to claim her? and can I get that money that he got for her?? because i AM the one who supports her???

ALSO.... i am married and i was married when I gave birth to her... im not married to her father, it s a different man... and so her father is not on the birth cert. he and i were never married.

No, it is not illegal for him to claim her.

If he was the breadwinner of the household he can legally claim her as a dependent if she lived there.
It doesn't matter who the actual father is.
It matters who has custody and can document that they are providing a home for the child.
If his name was on the lease then there is nothing you can do.
You were living there under his lease.
