Juvenile Crime errors on a summons

My 16 yr old daughter was charged for a&b, and disturbing a school assembly.

When we received the summons to appear in court. Her name was misspelled, her birthday was wrong, and she was listed as a male in the gender selection. Can we utilize these errors to have the case dismissed?

The case won't be dismissed for clerical errors.
The prosecutor will move to amend the errors.
The judge will grant the motion(s).

I suggest you plead not guilty upon your child's behalf.
If you can't afford an attorney, ask the judge if your family qualifies for a public defender.

After pleading not guilty, requesting an attorney, don't try to explain or discuss the arrest or charges.

Leave all such discussions for the child's attorney.

In the meantime, I suggest you have your child evaluated by a child psychologist and a child psychiatrist.

Young girls generally don't behave the way she is alleged to have behaved unless they are experiencing serious emotional disturbances.

Bottom line, see if she needs medical or psychiatric help.
