ERAC rented a car to an individual that had my DL in her possession. She used my DL and someone else's CC to obtain a rental which she ended up stealing. I have a few people telling me to sue the rental car company. I'm not a sue happy person and I don't feel I have a claim, but I've been told to open a law suit anyways to maybe change ERACs policies during rentals. If I can ill do it. I would like to help keep someone from the sleepless nights and stress that I have gone through the past few weeks. Please help me. I want to make sure something like this becomes not so common.

Your claim would be against the person who stole your ID, not the unwitting victim of their deception. How is it the rental car company's fault?

I suppose the car thief stole your drivers license, right?
I mean, you wouldn't allow her to use it for anything, right?
I mean, how on earth could she get away with using your drivers license?
Please tell me you didn't fall for the let me borrow your drivers license scam to rent a car, did you?
Have you reported the matter to law enforcement authorities?
What have the authorities told you?
You can also consult a licensed lawyer or two in your jurisdiction.
The initial meeting is normally free of costs.

I wonder how she got your driver's license (any idea) & someone else's credit card. Anyway, that would be the person who you would have any action against & not the rental car co.

Perhaps ERAC should sue you for allowing someone to obtain your license and causng them to have a car stolen. Turn about is after all fair play.
