Enforcing Homeowner Association By-Laws

Hello Folks,

I would like some legal advice on this one, I live in Michigan.

We live in sub which has established by-laws on the homes, structures, renovation, vehicle storage, appearance etc.
It clearly states when remodeling the "work plan must be approved by the Homeowner Assoc., structure and architecture must be in keeping with the surrounding homes."

The house next door burned 2 yrs ago, sat empty for 2 years & now that they have started re-building have gone from a 2100 sq ft colonial to a 3500 and it is bigger,wider, taller then any other home. They have never followed the appearance or lawn maintenance by-laws until they are threatened twice by the city to mow their lawn. That should START with the Homeowner's Assoc.

Their relatives also own the home next to them and do not follow the regulations as far as lawn maintenance and construction salvage that has been piled on their deck & next to that home for the past year.
Our Homeowner Association has done nothing even when we submitted a very civil letter to them about these issues. We never received a response.
When anyone moves into the sub, they are provided a copy of the by-laws and last year the by-laws were revised.

Can we sue our Homeowner Association for breach of contract or their lack of enforcing the subdivision regulations??
The mess next door has definitely prevented from even thinking of selling our home.
BTW, the Homeowner Association enforces a lien on your property if you do not pay the annual $180.00 fees!!!

You can either sue the HOA or you and like-minded people run for the board.
