Employer wont pay wages owed

Father and son team went over the road making deliveries. They were gone two weeks. The payment agreement made with the employer was 28% of the loads plus .03 per mile.
Upon return the employer phoned the team notified them where to drop the rental truck and told them he was closing the business. He is now not answering his cell phone and is not at the office building. His answering machine is now stating a new company name but the guy will not return calls. Do we have any legal recourse to get the wages that are owed for the work done? Grand Junction, CO
