I was awarded sole custody of my daughter 3 years ago. I was living in Kansas at the time with my husband who was in the military, though the case was through the Arizona courts. The ruling stated that I had permission to move with my daughter anywhere that was necessary due to my husband's military career.
"IT IS FURTHER ORDERED granting the mother permission to remove the child from the State of Arizona to her residence in Kansas or such other residence as may from time to time be required through her present family's obligations though the United States Military."
During his first visitation after the ruling my Ex kidnapped my daughter and hid out with her for a while in CA. It took over a month to get her back. As a result of the kidnapping he is now only allowed supervised visitation. Last year we moved back to Az following my husband's discharge from the military. Two months ago my husband lost his job due to downsizing and has so far been unsuccessful in obtaining a new one. We can no longer afford to live here and will most likely be evicted soon. If we do not get out of here we will be homeless.
The only modification to this order has been an order for supervised visitation that was entered in 2005. It has been more than a year since we left the military and moved to AZ. In that time no changes, modifications or requests for such have been made by either party.
My question is this:
How much notice do I have to give the non-custodial parent when we don't really have much time or warning in this matter? What are my options if we have to move suddenly? Is there some sort of emergency request to relocate that I can file?
