Alcohol & Drugs: DUI, DWI dwi and posession

my son is 16 and the other night he was pulled over for turning into the wrong lane, he was out past his ohio driving curfew. the officer said the car smelled like marijuana so asked my son to get out of the vehichle, the officer smelled marijuana on my son he then asked if my son had been smoking marijuana my son admitted that he had done it earlier in the night, when the officer told my son she would search the car my son gave her the 2 grams of marijuana that him and his two friends in the car had.He was then asked to take a urine test which he did.he was charged with a dwi and posession of marijuana.this is his first offense and he does very well in school and other activities, what consequences do you think will come from this?

Well, he must be convicted in order to face consequences.

Your son is a minor.

As a minor, you had the right to be present with him during any police questioning.

Bottom line, the police MAY have violated Junior's rights.

A lawyer can assist you in determining if there are any legal defenses and challenges available to save Junior's reputation and freedom.

Neither of us knows what went down on the street that fateful night.

I know that Junior is presumed innocent, until and unless proven guilty on a court of law.

I suggest you do the following:

Tell Junior to shut up about this, unless he is speaking to you or the lawyer you will hire to defend him.

If you can not afford a lawyer, ask the court to appoint one to represent him.

Junior should also was not guilty.

Junior's life could be ruined, if you don't help him fight this.


You and Junior also need to have a very long and involved parent and son dialogue. Junior needs you to read (and reread) him the riot act!
