What is the penalty for a 4th DUI in PA. The defendant has not had any offenses for 7 years and is mentally ill. Are there any factors the judge may take into consideration that could lessen the sentence? For instance, he made bad decisions and broke the law but he lost his job, couldn't afford his medications, is bipolar so was self medicating ( not an excuse ) and is also schizoaffective. ?Since the arrest happened he has been in a psychiatric hospital for treatment twice.
