Does my husband have to pay for legal fees for child's mother?

We live in Mississippi. My husband is seeking custody of my stepson. On the 7th we went to court and she gave us physical custody and joint legal custody as long as we did not make her have to have monitored visits (she has history of being in mental hospitals and moves alot). However a week later when she was suppose to go sign the papers she did not show, instead she called the lawyer and said she didn't have anybody to bring her there. She has her own car. She asked the lawyer to mail her the papers and stated that she would sign them and mail them back. Then called us and asked us to bring him back to her a day earlier than what we had discussed at court. My husband was trying to keep her happy so he agreed. A week later she still hadn't signed the papers when the attorney's secretary called she told her she'd have the papers there by that Friday when my husband was suppose to pick my stepson up. However when he got there, she came out and told him that she didn't have to give him to my husband he signed away rights to him when they did child support 7 years before and she had papers proving yet. But she wouldn't let him see the papers and my husband doesn't recall any of this. Then today my attorney called and told us that she has decided to fight the custody and that she wants US to pay her for attorney since she doesn't work and we lied about her and got her arrested (she threatened to shoot me and kept calling harassing us). She is also stating that we abuse him now, we do not know what she means by that, and that my husband isn't paying child support, which his check stubs prove he is. Can anyone tell me if she is correct in saying we have to pay for her attorney? She gave up custody of her other 2 children because it was deemed best for their wellbeing. She was then arrested last summer for not paying child support for them. She is also living with a man but married to another. My husband and she were never married so there has been no custody papers done before now. Since she gave an officer of the court her word that she was going to give us custody will that help our case. Will any of this help our case??

A: If the court orders it in the lawsuit, then yes.



Obviously, y'all need to listen to your lawyer.
 
She can ask that you pay her legal fees, doesnt mean she will get it. You can certainly fight it.
 
thank you for answering us we have a hard time getting in touch with our lawyer and my husband was extremely upset about this situation. we can barely afford our lawyer and was worried about having to pay for both. we finally heard back from her and she told us not to worry about this.
