does my daiughter need to file for custody and how much $$$ ?

My daughter and her ex-fiancee haven't been together for 2 yrs and have not had any legal custodial agreement for their 6 yr old daughter...they agreed when they split that he would have her every other weekend and overnight one night during the week.My daughter is now in a relationship and is afraid he will try something out of jealousy...she wants to have legal custody but says she can't afford the lawyers fees.How much money will she have to put out? By the way,the ex owes thousands of dollars in back support and is cuurently doing jail time for unpaid parking fees...
 
Your daughter may be able to file for custody on her own, though having a lawyer is preferable. You may be able to find the forms online if you google your state's or county's court self help website. If there isn't one, you can try your local courthouse. They may even have a family law facilitator who can help.

She really should have a formal custody/visitation agreement filed with the court if she allows visitation.
