I am a permanent resident (green card holder) since last 4 and half years now. I would be eligible to apply for my US Citizenship in few months. However, during this 4 and half years of my stay in US, I was charged with Petty Theft Infraction (first time offense). I was caught shoplifting at store and the officer charged me with Petty Theft PC 484-488. I hired a criminal attorney and we pleaded "NO CONTEST" and she worked out a deal in court to get my charges reduce to Petty Theft Infraction PC 490.1. The DA finally brought down the charges from Petty Theft Misdemeanor to PC 490.1 Infraction.
I will be eligible to apply for US Citizenship in few months. I am seeking advice to find out, if Petty Theft Infraction is considered as a Crime Involving Moral Turpitude or not? Will it effect my US Citizenship Application? Will I be denied of US Citizenship? Is Infraction considered as a CMT which can effect in US Citizenship application? Kindly, please advice.
Thanks,

Yes, theft is considered a CIMT. It would affect your application. The plea deal must meet the petit offense exception in order not to lead to deportation or inadmissibility. If it meets this exception, then you would be better served waiting for five years from the disposition of the case to apply for citizenship. You would be denied if you apply now.

you wouldnt qualitfied cause moral torpal cause it is too general. even lying to your friend is fall in to moral torpal . u are ban witl 5 years not phobited to apply.

All naturalization applicants must demonstrate good moral character, attachment, and favorable disposition.

therefore lying is not a good moral character.

i am not upset, look at the u.s.citizenship guildline. well my case is a d.a. rejected cause they dont have enought evidence and no they can three strikes me for an accident. it is a hard lesson learned and i will never make the mistake again that i vowed with god. i did a research on his cases and if you visit http://www.uscis.gov/portal/site/us...nnel=96719c7755cb9010VgnVCM10000045f3d6a1RCRD
