Do I have any rights?

My mother is currently living with my father but they are not married. They have lived together for more than 25 years. They have three children together all adults now. He constantly tells her to leave the house because he no longer wants anything to do with her. She is scared and does not know what to do because the house is under my father's name only. Is there anything that she can do about this issue? Even if they are not married does she have any rights regarding the house?

Only a few states legally recognize common law marriages. Some, if they had common law by a certain date, it would be grandfathered in.

http://www.unmarried.org/common.html has some info. Even if she has no legal rights to the house, she has some sort of tenants rights so she cannot be thrown out overnight but Dad can start eviction proceedings. This is assuming she is in a state where her common law is not recognozed at all.

If she is in a state that recognizes it, she should see an attorney.
