Do I have a leg to stand on?

I live in TX. I was hired by a company and given a 40K sign on bonus with the stipulation that I stay at least one year. However, upon arrival at my new job I found out that the position I had been hired for, no longer existed and I was stuffed into another role (one with similar duties) but one that I would have never left my old job to do. I am about to resign after 8 months. I feel that I should only have to repay a pro-rated amount. If they were to lean on me, would I have a case?

That would depend on the exact wording of the agreement you signed. You will need to show it to an attorney in your state. We cannot assess the enforceability of an agreement we haven't read.
